Bike&Trail Bicycle Rental Agreement & Policies
Definitions
“Bike&Trail” refers to the lessor.
The term "equipment" refers to all equipment and bicycles rented or given on loan from Bike&Trail. The term“Customer” refers to any person renting equipment and/or participates in guided bicycle tours
Responsibilities
The customer is responsible to check the bike, riding and/or operation, at the rental location before setting out on any ride. He will test the operating parts such as brakes, steering apparatus, tires, pedals and lock. Bike&Trail will adjust the bike seat to fit physique.
The customer agrees that the bicycle and any equipment attached thereto, at all times, remains the exclusive property of Bike&Trail. Bike&Trail is not responsible for any damage or theft on the equipment, throughout the duration of the rental agreement and/or before the equipment returned at the rental location.
Customers are required to obey Belgian traffic laws all times. For small repair and punctures, Bike&Trail provides customers with a multi tool, spare inner tube, pump and puncture repair kit. In the event of a mechanical failure – other than punctures – Bike&Trail offers breakdown service for the customer within a reasonable time and depending on the distance from the rental location. Bike&Trail will not rent a bicycle or any equipment to customers under the age of 18, without being assured of their parent(s) or guardian.
Bike&Trail advise to wear a helmet at all times. Bikes are rented out clean and in proper working condition and must be returned in the same manner. Bikes are maintained on a daily basis, customer agrees to return the bike in clean, undamaged condition to avoid any additional charges for repair, maintenance or replacement of any equipment. Customers accepts use of the equipment, as it is, in good condition and accepts full responsibility for care of the equipment while under his/her possession. Damaged parts or components will be repaired/replaced by Bike&Trail’s discretion and customer agrees to pay regular shop rates and retail prices for components replaced. Paint damage will reduce the value of the bike, in case of paint damage 10% of the sales value can be charged.
The deposit fee (maximum 10% from retail price of the bike’s) is charged as a precautionary measure in view of the possible damage or non-return of the bicycle and equipment hired out. In case of any equipment lost, stolen or damaged, the customer shall pay to cover such loss, theft or damage. The Customer agrees to immediately report to Bike&Trail and the Police department a stolen or lost bicycle. The Customer is responsible end liable for any misuse, consequences, claims, demands, causes of action, losses, liabilities, damages, injuries costs an expenses, penalties, legal fees, judgments, suits, or disbursements of any kind or nature related to a stolen or lost bicycle. By signing the rental agreement, the customer automatically agrees to the rental conditions.
Bicycle rental assumption of risk and liability agreement
Bike rental and/or participation in a guided MTB tour is at the Customer’s own risk, Mountainbiking is an outdoor activity sport. Customers are expected to understand the risks involved in this type of sport.
Assumption of risk: I understand and accept that renting this bicycle and participating in biking exposes me to many hazards and entail unavoidable risk of death, personal injury (including but not limited to servere spinal or head injury). I understand the inherent risk involved in using this equipment; accept full responsibility for any and all such damage or injury that may result.
Waiver and Release: In considiration of Bike&Trail renting me this equipment/bicycle, I specifically release and forever discharge Bike&Trail and its affiliates, officers, agents, and employees from any and all liability or claims for injury, illness, death or loss of or damange to property which I may suffer while renting this bicycle/equipment and participating in bicycling. This discharge specifically includes, but is not limited to, liability or claims for injury, illness, death or damage caused by the negligence of Bike&Trail or its affiliates, officers, agents, or employees. It is my intent by the Waiver and Release Agreement to release Bike&Trail and hold it harmless from all liability for any such property loss or damage, personal injury or loss of life, whether caused by the negligence of Bike&Trail or whether based upon breach of contract, breach of warranty, or any other legal theory. In signing this document, I fully recognize responsibility that if injury, illness, death or damage occurs to me while I am engaged in renting this bicycle/equipment or participating in bicycling.
I will have no right to make a claim or file a lawsuit against Bike&Trail or its affiliates, officers, agents or employees, even if they or any of them negligently cause my injury, illness, death or damage. I realize the importance of wearing a helmet. If I do not wear a helmet I am doing so at my own will.
Conditions:
Bike&Trail staff has answered any questions I have had. I understand these bicycles may not have visibility enhancement equipment as such.
Bike&Trail is not responsible for any fines or penalties that may result from the breach of these traffic laws. The user is aware of the risks of cycling and will be solely responsible for damages to themselves, to others, to property, movable or immovable by normal or abnormal use of the bikes.
Bike&Trail is not liable for claims of injury or damages caused to themselves, to others and/or their property.
The customer is obliged to respect the traffic laws and rules and therefore is reponsible for all damages caused as a consequence of any accident that occurs during the use of the bike.
